1. Introduction

   Thank you for reviewing Apexoo’s Terms of Service (“TOS”)! By using any Apexoo product or service (“Apexoo Services”), you agree to be bound by the following terms and conditions.

2. Content Linked to by Apexoo

   As Apexoo exercises no control over those who have developed the sites that are displayed by or linked to from Apexoo Services and as Apexoo’s listings are indexed and populated using automated software with no human review before posting, using Apexoo Services may produce search results or links to sites that some people may find objectionable, inappropriate, or offensive. Apexoo assumes no responsibility for the content of any site included in any search results or otherwise linked to by Apexoo Services.

3. Non-Commercial Use Only

   Apexoo Services are made available for your personal, non-commercial use only. You may not take the results from an Apexoo search and display them or reformat them, or mirror the Apexoo home page or any results pages on your website. If you want to make commercial use of Apexoo Services, you must enter into an agreement with Apexoo for this purpose in advance. Please contact us for more information.

4. Automated Queries

   You may not send automated queries of any sort to Apexoo's system without express permission in advance from Apexoo. Automated queries include, but are not limited to, “meta-searching” Apexoo and any software that queries Apexoo to determine where a website ranks for certain search terms.

6. Changes in Terms and Conditions

   We reserve the right to modify the TOS from time to time without notice. Please review the TOS from time to time so that you will be aware of any changes.

7. Changes in Apexoo Services

   We may modify or terminate our services from time to time, for any reason, without notice, including the right to terminate without notice any other user or any third party service provided through or by Apexoo.

8. Copyright Policy

   It is our policy to respond to notices of alleged infringement that comply with the Copyright Act of Canada. For directions and more information, please visit the Copyright Board of Canada to view the Copyright Act.

9. Requests for Removal

   At Apexoo, we reserve the right to address requests for removal of links or cached materials on a case-by-case basis. Our general approach reflects the following principles:

   • If a link or cached material no longer represents the content available on that site because (a) the site owner has restricted access to the site or (b) the site has been removed from the web, then, upon receipt of a request by the site owner or a third party in the second instance, Apexoo would consider the request to remove the link or cached materials from its indices.
   • However, as the automatic system used to create Apexoo’s indices will likely find the site and index it again in a short amount of time, the owner / operator of the site should take steps to prevent this from happening.
   • If the site owner wishes to block Apexoo from returning cached results of their web pages, the site owner operator should use the NOARCHIVE meta-tag.

10. Miscellaneous

    This TSO will be governed by and in accordance with the laws of the Province of British Columbia, without giving effect to its conflict of laws, provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of this TOS to be unenforceable, the remainder of the TSO will continue in full force and effect. This TOS constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the TOS will be effective only if in writing and signed by Apexoo.
